Terms of Service
The rules for using Roleplaycharacters.ai, its fictional adult character systems, Tokens, AI images, and community features.

These Terms of Service (“Terms”) are an agreement between you and Third Oak Productions, LLC (“Third Oak,” “we,” “us,” or “our”) governing Roleplaycharacters.ai, its characters, game systems, websites, and related services (collectively, the “Service”).
By creating an account, accessing the Service, or purchasing anything offered through it, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. Adults only
You must be at least 18 years old and legally able to enter this agreement. Every character represented by the Service is a fictional adult. Content that depicts, describes, sexualizes, exploits, or attempts to create a person under 18 is prohibited.
We may require age confirmation, email verification, or other reasonable account checks. Providing false eligibility information may result in suspension or termination.
3. Nature of the game
Roleplaycharacters.ai is a fictional character-collecting and generational simulation game. Players collect permanent adult character cards, use closed-loop gameplay Tokens, create permitted character content, and interact with systems such as Lifecycle, Marketplace, Gifts, Awards, Story & Journal, and ancestry.
“Mating” is a non-graphic probability and ancestry mechanic used only to determine whether a new fictional adult offspring character card is created. The Service does not depict or describe sexual activity through this mechanic. It is not an adult service, dating service, or content designed for sexual gratification.
Fertility, mating, pregnancy, ancestry, inheritance, and offspring are game statistics and simulated outcomes. They are not medical facts, advice, or representations about real people. A newly delivered offspring card represents a fictional adult and is never presented as a minor.
Random or probability-based gameplay outcomes do not award money or cash-equivalent prizes. Tokens and game assets cannot be redeemed for cash through the Service.
4. Accounts and security
You must provide accurate registration information, maintain one authorized account unless we approve otherwise, protect your password and sessions, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.
You may not sell, transfer, share, automate, scrape, reverse engineer, disrupt, or use another person’s account. Testing accounts and administrator tools may be used only for their intended purposes.
5. Tokens, payments, and subscriptions
Tokens are a limited, revocable, non-transferable license to use designated features inside the Service. They are not money, cryptocurrency, a bank account, stored value redeemable for cash, or an ownership interest. Except through an expressly authorized in-game transaction, Tokens may not be sold, transferred, exchanged, or redeemed.
Prices, included Tokens, recurring terms, capacity limits, renewal timing, cancellation rules, and other material purchase terms are shown before checkout. Payment processing may be provided by Stripe or another disclosed payment provider. We do not intentionally collect or store complete payment-card numbers.
Refunds, reversals, and disputes may cause related Tokens or undelivered benefits to be held, deducted, or recovered. If associated Tokens have already been spent, gameplay purchasing and transfers may be restricted while the resulting recovery amount is resolved. Fraud, chargeback abuse, or payment evasion may result in account restrictions.
Unless a checkout disclosure or applicable law states otherwise, gameplay actions already completed and digital benefits already delivered are not reversible merely because the player dislikes a probability outcome or an AI-generated result.
6. Permanent cards and immutable records
Character Card IDs and core generated attributes are permanent. Certain submissions and histories—including Backstories, Character Journal entries, Life Events, Awards, ownership history, gift history, transaction evidence, ancestry, and moderation evidence—may be immutable by design. “Immutable” means players cannot edit or erase the historical record through ordinary controls; authorized moderation may suppress public display while retaining evidence.
Ownership of a card means the current in-game collection right defined by the Service. It does not transfer our software, character-system, trademark, or platform intellectual property. Card ownership may change through authorized game mechanics, account deletion, moderation, reset, or other rules disclosed by the Service.
7. AI images and player content
AI image generation is imperfect. Results vary and may not exactly match a prompt or character. By submitting a request, you accept the disclosed price and the delivered result on an as-is basis, subject to confirmed technical failure and moderation handling described by the Service.
You may describe permitted clothing, locations, activities, atmosphere, and other supported scene details. You may not use the Service to request, upload, publish, or facilitate:
- nudity, pornography, depicted sexual acts, erotic roleplay, fetish services, or other content intended for sexual gratification;
- sexual content involving or appearing to involve anyone under 18;
- illegal content, exploitation, non-consensual intimate imagery, trafficking, or sexual services;
- harassment, credible threats, hateful abuse, unlawful violence, impersonation, fraud, or infringement of another person’s privacy or intellectual-property rights;
- malware, credentials, payment-card information, API keys, or other secrets.
Swimwear, ordinary relationships, reproduction statistics, pregnancy status, and non-graphic ancestry gameplay are not inherently prohibited, but context and intent matter. We may reject or moderate any request that creates unacceptable legal, safety, provider, or platform risk.
You retain rights you already hold in original content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, transform, moderate, display, and distribute that content as necessary to operate, secure, improve, and promote the Service, subject to the Privacy Policy and any more specific interface disclosure.
8. Community conduct and moderation
Do not harass players, spam, manipulate flags, exploit bugs, evade restrictions, coordinate deceptive transactions, or misuse Private Notes, profiles, journal entries, Marketplace, mating, gifting, or support tools. Reports must be made in good faith.
We may review reports, prompts, generated media, public submissions, private messages when reported or otherwise lawfully necessary, transaction evidence, and relevant security logs. We may warn, restrict, hide, reject, suspend, or terminate accounts and content. Moderation decisions may preserve immutable evidence even when public display is suppressed.
9. Availability, changes, and resets
The Service may change, pause, experience errors, or be discontinued. Features, probabilities, prices, Token costs, generation providers, and limits may be adjusted prospectively. Testing installations may be completely reset; the active site mode and any applicable reset warning are authoritative.
We do not guarantee uninterrupted operation, preservation of testing data, a particular character value, marketplace demand, mating outcome, image result, or continued availability of a third-party provider.
10. Intellectual property
The Service, software, interface, rules, databases, branding, and original platform materials are owned by Third Oak or its licensors and are protected by applicable law. These Terms provide a limited personal right to use the Service; they do not transfer ownership of the platform.
You may not copy, commercially exploit, frame, mirror, or create derivative services from protected platform materials except as expressly permitted in writing or by applicable law.
11. Disclaimers and limitation
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
To the maximum extent permitted by law, Third Oak and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss of anticipated game value arising from the Service. Any direct-liability limit will be the greater of the amount you paid us during the twelve months preceding the claim or the minimum amount required by applicable law.
12. Suspension, termination, and deletion
You may stop using the Service or request account deletion through Privacy & Safety. The disclosed cooling period, transaction safeguards, permanent game history, financial retention, legal holds, and card-release rules apply.
We may suspend or terminate access for violations, risk, legal requirements, provider requirements, payment disputes, or threats to the Service or its users. Provisions concerning permanent records, intellectual property, payments, disclaimers, disputes, and retained evidence survive termination where applicable.
13. Changes and contact
We may update these Terms. Material changes will receive a new version and, when appropriate, renewed consent. The effective version is displayed on this page.
